Ever since homosexuality was decriminalized in the late 1960s homosexuals have been struggling for equality in society advocating for same sex marriages. In 2005 the House of Commons enacted legislation that legalized same sex marriages. Do same sex marriages threaten the existing traditions and cultural conception of the institution of marriage? Are they parallel or in contrast with nature? Should same sex marriages be allowed in the contemporary society? This thesis explores these views in detail.

It is argued that Perry has stabbed a knife into the traditional institution of marriage as understood it this modern age. By legalizing same sex marriages and relating it to the doctrines of traditional marriage institutions there is the potential risk for the meaning of marriage to grow even further and encompass other associations such as incest bigamy and other forms of association which will eventually erode the meaning of marriage. What would subsequently follow is the steady separation of marriage and intimacy from childbearing leading to substitution with technological applications and surrogacy commercialization of the institution of marriage. Eventually the temptation would lead the state to assign children to suitable families since biological relationships would no longer have any value in the society.

The institution of marriage is a conservative cultural institution that would be emasculated if same sex couples are acknowledged by the state. The values entrenched in the institution of marriage are intricate. In this case the institution is formed by culture and acknowledged both in public and private realms. Marriage is described and adheres to formal and informal dictates of a broad range of religious institutions. Religious institutions enjoy a certain amount of autonomy from the state. Therefore they have the authority to ascribe their own understanding of the value and nature of marriage as a social cultural institution.

Since the distinction between sexes came from God marriage also originated from God as a way to express union and love in the Lord. This is referred to as divine marriage in religious circles. It is argued that from this divine marriage the universe or the world as it is today was born. God created man in his own image. There is a reason as to why man and woman were created. Masculine beauty symbolizes Gods wisdom and feminine beauty symbolize love. It is argued that love flows from woman to man. Thus same sex marriages do not adhere to these religious doctrines.

History alone cannot be a sufficient reason to sustain traditional marriage regulations. However history should play an integral part in some thoughtful arguments for the sustenance of traditional marriage institutions. The persistent argument about the source nature and rationale of marriage should be the initial point for any logical debate about the modesty of recognizing same sex marriages. This is especially when it involves very tender and critical topic of marriage. Individuals should amend and alter cultural ethical teachings. However this should only be with sufficient trepidation elongated explanation and only with full exposure of what is at stake on both divides of the debate.
